On May 25, the Criminal Division 1 of the Wonju Branch of Chuncheon District Court, presided over by Judge Kim Hyun-jun, sentenced the defendant, identified as Mr. A (31), to one year and two months in prison for violating the Road Traffic Act. According to court records, Mr. A was reported to the police on November 3 of last year for suspected drunk driving in a neighborhood of Wonju, Gangwon Province. When officers arrived and requested a breathalyzer test, he refused three times over approximately 10 minutes. Despite the officers' explanations and the presence of a positive alcohol detection reading, Mr. A repeatedly stated, “Yes, I drank, but do you have proof I drove? I won’t comply.”

The prosecution’s case included witness testimony and evidence showing that Mr. A had driven about 345 meters shortly before the police arrived. A concerned citizen had called emergency services, reporting that “a drunk driver is in the vehicle, attempting to flee.”

Judge Kim pointed out that Mr. A had been convicted twice for drunk driving in the past ten years and had previously received a suspended sentence. Additionally, he had once fled the scene after causing an accident under the influence. “Despite this record, he again drove while intoxicated and then refused to cooperate with law enforcement,” the judge noted.

“The refusal to take a breathalyzer is not a trivial act but a deliberate attempt to avoid DUI punishment, posing a serious threat to public safety,” the ruling stated. However, the judge acknowledged that the defendant admitted to the charges during the trial and expressed remorse, which was taken into account in determining the sentence.
