Former President Yoon Suk Yeol was sentenced to 30 years in prison in a first-instance ruling after being found guilty of ordering a drone operation over Pyongyang to create a pretext for the declaration of emergency martial law on December 3.

Although Yoon had argued that the operation constituted a legitimate military response to North Korean provocations, the court determined that the objective was to induce a hostile reaction from North Korea in order to manufacture conditions favorable to imposing martial law.

🔹Court Sentences Yoon to 30 Years in Prison
The Criminal Division 36 of the Seoul Central District Court, presided over by Judge Lee Jeong-yeop, handed down a 30-year prison sentence to Yoon on June 12 on charges including benefiting the enemy and abuse of authority.

The court also sentenced former Defense Minister Kim Yong-hyun to 30 years in prison and former Defense Counterintelligence Commander Yeo In-hyung to 15 years.

Meanwhile, former Drone Operations Commander Kim Yong-dae, who directed the execution of the drone mission, received a three-year prison sentence suspended for five years.

Yoon's sentence matched the punishment sought by the special counsel, while Kim Yong-hyun received a harsher sentence than the 25 years initially requested by prosecutors.

🔹"Attempted to Create a National Emergency to Justify Martial Law"
In its ruling, the court strongly criticized the defendants' actions.

"The defendants exploited their constitutional authority as commander-in-chief and defense minister to provoke North Korea under the guise of a military operation," the court stated.

"The presidential power to declare martial law exists to address military necessity and preserve national security and public order. Deliberately attempting to create a state of emergency for the purpose of declaring martial law fundamentally contradicts the very purpose of that authority."

The court further noted that such actions betrayed public trust.

"The people entrusted the defendants with military command authority under the assumption that it would be exercised solely for legitimate national defense purposes. That trust was violated."

🔹Court Rejects Claim of Legitimate Military Operation
The court concluded that the Pyongyang drone operation was not conducted for military necessity but rather to establish political justification for emergency rule.

According to the ruling, Kim Yong-hyun pushed ahead with the operation despite internal objections from military officials and without adequately informing the National Security Office.

The court also cited meetings involving Yoon and senior security officials in 2024, during which discussions regarding emergency powers allegedly took place.

Based on the evidence presented, the court found that preparations for martial law and efforts to generate a triggering event had proceeded simultaneously.

🔹"Military Interests of the Republic of Korea Were Harmed"
The court determined that the operation endangered South Korea's military interests by increasing the possibility of military confrontation with North Korea.

It noted that North Korea's responses are inherently unpredictable and that provoking hostile action carried substantial security risks.

The ruling stated that the fact North Korea ultimately did not launch a major retaliatory attack could not be considered a mitigating factor for the defendants.

The court further found Yoon and Kim guilty of abuse of authority, concluding that they compelled military personnel to perform unlawful tasks unrelated to their official duties.

🔹Defense Teams Immediately Appeal
Following the verdict, Yoon's legal team strongly criticized the ruling and announced plans to appeal.

"The court has criminalized military responses intended to defend the nation and has characterized efforts to counter North Korean provocations as acts benefiting the enemy," Yoon's attorneys said.

They argued that the drone operation represented a proportionate response to a new form of security threat and insisted that the former president was innocent.

Kim Yong-hyun's legal representatives likewise confirmed their intention to challenge the ruling through the appeals process.
