📍Supreme Court Upholds Conviction Over Bribery and Sexual Misconduct Charges
Kim Jin-ha, the mayor of Yangyang County, has officially lost his office after South Korea’s Supreme Court finalized a two-year prison sentence over bribery and sexual misconduct charges.
The case attracted nationwide attention because the courts recognized not only money and gifts, but also “sexual benefits” connected to official duties as a form of bribery. Judges concluded that Kim maintained an inappropriate relationship with a civil petitioner while handling administrative requests and local complaints.
The ruling is expected to leave a significant impact on local politics in Yangyang, where the controversy had already escalated into a resident-led recall vote before reaching the Supreme Court.


🔹 Supreme Court Finalizes Two-Year Prison Sentence
The First Division of the Supreme Court dismissed Kim’s appeal on May 8, upholding convictions for violating the Improper Solicitation and Graft Act, accepting bribes, and forcible molestation charges.
The court finalized a sentence of two years in prison and a fine of 10 million won. It also upheld the confiscation of a massage chair and an additional forfeiture order of 5 million won.
The Supreme Court stated that the lower courts had conducted sufficient examination of the evidence and had not misapplied legal principles. The justices also ruled that the previous courts had remained within the acceptable limits of judicial discretion.
Under Korean law, elected officials automatically lose office once a prison sentence or heavier punishment becomes final. Kim therefore immediately lost his mayoral position following Thursday’s ruling.
The decision marks another case in which an elected Yangyang County mayor failed to complete a term in office.
🔹 Allegations of Cash, Gifts, and Administrative Favors
According to prosecutors, Kim accepted money and expensive gifts from a civil petitioner identified only as A between December 2018 and December 2023.
The requests allegedly involved land-use zoning changes, road occupation permits, and the resolution of civil disputes.
Prosecutors argued that Kim received multiple cash payments and also accepted a massage chair through his spouse.
During the trial, fierce legal disputes continued over the timing and legitimacy of the alleged payments. While the court acquitted Kim on some allegations due to insufficient evidence, it recognized the receipt of 5 million won in cash in December 2023 and the massage chair as guilty findings.
The court also ruled that the massage chair received by Kim’s spouse effectively constituted a benefit provided to Kim himself.
🔹 Court Recognizes Sexual Relations as Bribery
The most controversial issue in the case was whether Kim’s sexual relationship with A could legally qualify as bribery.
Prosecutors argued that A provided sexual benefits in expectation of administrative favors and assistance with civil complaints. Investigators determined that the two had engaged in sexual relations multiple times.
Kim denied wrongdoing, insisting the relationship was purely personal and unrelated to his official duties. His legal team argued that a consensual affair should not be treated as criminal bribery.
However, both the trial court and appellate court rejected that argument. Judges ruled that sexual acts and sexual benefits can legally constitute bribery when connected to official authority or administrative influence.
The courts determined that the background, timing, and relationship between the parties could not reasonably be viewed as merely private.
In its ruling, the appellate court criticized Kim, stating that repeatedly accepting sexual benefits from a petitioner represented “extremely poor criminal conduct.” The court also said the case seriously damaged public trust in fairness and transparency within Yangyang County’s administration.
🔹 Some Molestation Charges Rejected
Kim also faced accusations of forcibly embracing and sexually harassing A.
However, the courts ruled there was insufficient evidence to fully prove coercion in those allegations. Both lower courts acquitted Kim on part of the forcible molestation charges, and the Supreme Court upheld those findings.
Even so, the courts concluded that the broader bribery structure and the exchange of benefits related to official duties had been sufficiently established.
🔹 Related Defendants Also Convicted
The Supreme Court also finalized rulings against other individuals connected to the case.
A was convicted of blackmail after allegedly using photographs taken during sexual encounters to threaten Kim. The court upheld a prison sentence of one year and six months.
Meanwhile, Park Bong-gyun, a former Yangyang County council member accused of conspiring with A to threaten Kim, received a one-year prison sentence suspended for three years.
The case has been viewed as a complex scandal involving corruption, inappropriate relations between a public official and a petitioner, extortion, and exchanges of money and favors.
🔹 Political Career Ends in Disgrace
Kim previously worked for Gangwon Provincial Government and Yangyang County before entering politics.
He was first elected mayor in 2014 and later won reelection in both 2018 and 2022, achieving three consecutive terms.
However, allegations of sexual misconduct last year rapidly destabilized his political career. Kim later left the conservative People Power Party and continued his legal battle as an independent politician.
Residents even initiated a recall vote against him. Although the vote failed because turnout narrowly missed the required threshold of 33.3 percent, participation reached 32.25 percent — one of the highest recall turnout rates ever recorded for a local government head in South Korea.
Concerns about administrative instability had already been growing within the region. Yangyang County is currently operating under acting mayor Tak Dong-su.
County officials stated that major regional projects, including the Seoraksan Osaek cable car project and a smart land-based salmon farming complex, would continue without disruption.
