[26.04.04] Kim Chang-min Death Case, Police Mishandling and Hip-Hop Controversy
📍Assault in Front of Autistic Son → Brain Death → Death…Police Mishandling, Investigation Controversy, and Suspect Behavior Spark Public Outrage
The group assault death case of film director Kim Chang-min (40), which occurred at a restaurant in Guri, Gyeonggi Province in October 2025, is drawing increasing public outrage as more details emerge. The incident, which involved a brutal assault in front of his autistic son, inadequate initial police response, issues revealed during the investigation, and the perpetrators’ lack of remorse, has become a complex controversy. In particular, the fact that one of the suspects released a hip-hop track after the incident has intensified criticism.

🔹 Incident Origin…Dispute During Meal Leads to Tragedy
In the early hours of October 20, 2025, film director Kim Chang-min visited a 24-hour restaurant after his autistic son expressed a desire to eat pork cutlet. While dining with his family, a dispute arose with a group of men in their 20s at a nearby table over noise issues.
The situation escalated beyond a verbal argument and quickly turned into physical violence. Kim was punched in the face and body by the group and fell to the ground, and the assault continued afterward.
🔹 Witness Testimonies: “Six Perpetrators…Unilateral Assault”
Additional testimonies from witnesses at the scene further revealed the severity of the incident. Witnesses stated that there were six perpetrators and that Kim was immediately and unilaterally subdued by the group.
In particular, Kim was placed in a rear chokehold by one of the attackers and lost consciousness. He had already lost consciousness inside the restaurant, and the perpetrators dragged him outside, where they continued the assault.
Even more shocking was the behavior of the perpetrators. Some were reportedly laughing or appearing to enjoy the situation while watching the assault. These details further intensified public anger.
🔹 Condition Worsens After Hospitalization…Brain Death and Organ Donation
After the assault, Kim was transported to a nearby hospital. At the time, he was reportedly still conscious enough to board the ambulance on his own. However, his condition rapidly deteriorated afterward.
Approximately two weeks later, on November 7, 2025, Kim was declared brain-dead. His family decided to proceed with organ donation in accordance with his wishes, and he passed away after saving four lives.
🔹 Police Initial Response Controversy…No Arrest at Scene
The police response immediately after the incident sparked major controversy. Officers who arrived at the scene did not arrest the perpetrators, citing that Kim had boarded the ambulance on his own.
Instead, they only recorded the suspects’ personal information and allowed them to return home. This raised criticism over the failure to secure the suspects despite clear evidence of group assault.
🔹 Suspect Identification Issues…Family Secures Evidence
Problems also emerged during the investigation. CCTV footage from inside the restaurant clearly showed at least two perpetrators assaulting Kim, yet the police initially identified only one suspect and referred the case to the prosecution.
It was only after the victim’s family independently secured CCTV footage and witness statements that additional evidence was submitted. Based on this, the police formed a reinvestigation team and identified another suspect.
During this process, the charge was changed from “injury resulting in death” to “assault resulting in death,” likely due to difficulties in proving intent in court.
🔹 Arrest Warrants Denied…“No Flight Risk”
Police applied for arrest warrants for the two suspects, but the court denied the requests. The court cited that the suspects had fixed residences and posed no risk of fleeing.
Some criticized the decision, arguing that the severity of the outcome warranted detention. However, under current legal principles, non-detention is the default, and detention is applied only when necessary.
🔹 Police Statement…“Judgment Call by Investigators”
As criticism grew, the Guri Police Station stated that the investigation was based on the judgment of investigators and that an incorrect judgment does not necessarily constitute wrongdoing. This response, however, drew further criticism for appearing to evade responsibility.
🔹 Suspect Releases Hip-Hop Track Without Remorse
Controversy continued even after the incident. Personal information of the suspects, including photos and names, has spread online and on social media.
In particular, one suspect reportedly released a hip-hop track with an acquaintance after the incident, without showing signs of remorse. The song, published on YouTube, includes lyrics such as “The innocent me is already gone” and “I’ve become like a thug.”
The timing of this release, following the victim’s death, has drawn strong public criticism.
🔹 Organized Crime Allegations Denied
There were also allegations that the suspects were affiliated with an organized crime group in the Guri area. However, the group denied this, stating that the individuals were merely acquaintances and not official members.
🔹 Legal Gap Highlighted…No Aggravated Punishment for Violence in Front of Child
The incident has drawn additional attention because it occurred in front of a child with autistic tendencies. However, current law does not clearly provide for aggravated punishment for violence committed in front of a victim’s family.
It is also difficult to apply emotional abuse provisions, leading to calls for institutional reform.
